    I work at a collision repair shop in North Dakota and have been tasked with obtaining a title for a vehicle left at our facility so we can fix it up to be a loaner vehicle for our customers. It was left here about two years ago, we never had contact with the owner and have not been able to contact her since. She wrecked into a fence and called a tow company. She asked them to bring it to us and never came to get her vehicle. All calls and letters sent to her address have not been answered and the damage was never fixed. We have tried working with the state to find the necessary forms to identify lien holders to get the ball rolling but the forms are sent back to us saying we need “Proof of Contract”. We have no proof of contract because the owner never came to our facility. Our attorney is not interested in helping.

    After reading other posts, it seems like it may be possible to have the tow company take possession of the vehicle and sell the title back to us. Would this actually work for the situation? Does anyone know what forms would be needed to start the process without going through the towing company?

    Because the laws vary so widely from state to state this issue is a good one to direct at a local trade or business association. Will they ask that you join? Of course. Being in North Dakota severely limits your options, however, someone somewhere can like help. How about this group? I suspect they run into similar situations.
